Refunds, Returns, Warranty, and Shipping information
TBH Performance Co. wants you happy - let’s work together to get any issues resolved! Please note these key points before proceeding with any claim:
- Start at the original place of purchase. 100% of claims start with the original place of purchase, and all refunds, if granted, are through the original place of purchase. Call them first.
- If you remove, we cannot approve. If a product issue is discovered after installation, do not remove the product before receiving confirmation of return approval from the original place of purchase. On-car information can often lead to diagnosis and action plans; TBH Performance Co. requires a chance to address in this manner. Post-install products removed prior to return authorization will be denied any warranty claim.
- All warranties are for the original owner only. Second owners can purchase replacement components if needed.
- If you are a dealer or bought through TBH Performance Co. directly, contact our customer support via e-mail, SMS, or phone call.
- Orders or parts of orders canceled more than 48 hours after placement will be assessed a 20% raw-materials allocation fee. This applies to all exhaust systems. If a special operations exhaust is ordered and it is not in stock, please allow for 8 to 12 weeks for it to be manufactured for you.
- An order cannot be canceled once it has shipped.
TBH Performance Co. sources parts from USA and other countries to stock our inventory TBH Performance Co. incurs material and shipping costs from domestic and international suppliers as soon as customers place orders.
NON-RETURNABLE ITEMS (NO EXCEPTIONS):
- Electrical items
- Universal Valved Mufflers once installed
- Special ordered exhaust systems
- Missing factory boxes or packaging. Must be returned with ALL factory packaging as it came from TBH Performance Co.
- Undocumented shipping damage or mis-packaged items
- Incomplete returns, missing hardware or components
- Damage from misuse or improper installation
- Over 30 days since delivery date
- Preorder items
RETURNABLE ITEMS (SUBJECT TO 30% RESTOCKING FEE):
- In-stock items
- Universal Valved Muffler kits (uninstalled)
DAMAGED RETURNS WILL INCUR ADDITIONAL FEES.
The return window lasts for 30 days from the delivery date. After this time period has elapsed, no returns will be granted.
Issuing of refunds
All approved refunds will be handled by the original place of purchase, no exceptions. Since payments were made to the original place of purchase, any refunds must come from the same place. Please note that approved returns must be received at TBH Performance Co. HQ within thirty (30) days of approval of return to receive credit.
Discontinued products
In the event that a warranty claim is approved by TBH Performance Co. on a product that has been discontinued, TBH Performance Co. will pay to have the repair made to the product if it is deemed repairable. At TBH Performance Co.’s sole discretion and if applicable, a substitution of a comparable product may be granted should a repair not be deemed possible.
Warranty against manufacturer defects by product class
Manufacturer defect is defined as any characteristic of the product which hinders its usability for the purpose for which it was designed and manufactured. The warranty against manufacturer defects doesn’t cover any cosmetic changes, or normal use wear and tear. All warranties cease at a product’s discontinuance. All products come with a 1-year warranty from the purchase date, with exclusions noted below.
- Hardware and Gaskets are EXCLUDED.
Condition of system
In the event of a return, a product must be returned with no signs of abuse, incorrect installation, forced installation, motorsports usage, or product altering whatsoever. Any trace of the aforementioned will result in warranty denial.
Action
Upon verification of warranty coverage, TBH Performance Co. will, at its sole option, repair, consult toward remedy, or issue a refund for the defective product.
Warrantied Replacement Parts & Systems
If a part or whole system is issued as a replacement, the purchaser has 30 days to return the original part or unit back to us. If not received after 30 days, the purchaser is responsible for the cost of both items.
Labor
Labor for original installation, removal, and subsequent installation/inspection is not covered.
Shipping
If a claim is determined by TBH Performance Co. at its sole discretion to be a manufacturer defect, TBH Performance Co. will cover two-way shipping to TBH Performance Co. either from consumer or dealer and back to either consumer or dealer. TBH Performance Co. may also request a “Destroy in Field” of any defective parts.
Restocking
No restocking fee for Manufacturer Defect.
Exclusions
In all cases, TBH Performance Co. must be afforded the opportunity to remedy the situation before the removal of the product from the vehicle. Installations deemed errant by TBH Performance Co. will result in denied claims. Any evidence of abuse, whether it be with the use of flame tuning or use of the product in motorsports or racing conditions, is grounds for warranty denial. Warranties will be voided if the product is improperly serviced, modified, or used in a way not intended by the Manufacturer. The Consumer is responsible for ensuring that the product is installed in a safe and proper manner and should cease use of the product immediately if an unsafe or improper condition is noted. If an unsafe or improper condition is noted, the Consumer should then immediately contact the facility where the product was purchased.
Shipping Damages (WHAT TO DO?)
TBH Performance Co. cannot be held liable for refusal of, delay of, loss of, theft, or damage to a shipment of any item. The customer agrees to indemnify TBH Performance Co. for all costs, fees, and expenses TBH Performance Co. incurs as a result of any violation of any local, state, federal, national, or international laws or regulations. Customer agrees to take responsibility for lost packages that were not independently insured or sent without requiring a signature. The customer understands they will be liable in the event of additional fees, tariffs, or legal issues such as border seizure. Customer accepts these risks and agrees to release TBH Performance Co. of all liability. All packages are sent without a signature unless requested.
TBH Performance Co. reserves the right to charge a shipping and handling fee on every order being shipped from our facility. This fee is universal and applies to all retail and wholesale purchases and cannot be waived or credited.
Extreme care goes into the handling and packaging of each TBH Performance Co. product. All packages are shipped with the appropriate amount of insurance and packing material. If a package appears damaged on arrival, state the damaged condition and have the driver acknowledge the damage condition as well. In the case that products appear damaged after opening, contact the carrier immediately. Save all packaging for the claim inspection.
IF AN ITEM IS DAMAGED DURING SHIPPING, FOLLOW THESE STEPS:
- Please submit:
- 10 photos of the exterior of the box showing the damage from all angles
- 10 photos of the interior of the box with all contents inside
- 10 photos of the interior of the box with all components removed from the box
- Please send these images to us on our support page, we will then open a claim with the carrier. This is the ONLY way we can process a shipping claim. Without pictures of the damaged area, we will not be able to get the carrier to refund you so please be detailed. Any funds returned from the carrier will be transferred to you in the form of a refund to your original payment method.
Applicable to all warranties
EXCEPT AS EXPRESSLY SET FORTH WITHIN, TBH Performance Co. MAKES NO WARRANTY, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL TBH Performance Co. BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES HOWEVER CAUSED, ON ANY THEORY OF LIABILITY, AND WHETHER OR NOT TBH Performance Co. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The warranties listed herein are the only remedy the Consumer or Dealer has for any loss or damage, however arising, due to nonconformity in or defect of the product. This warranty does not cover consequential damage, loss of time or revenues, labor, inconvenience, loss of use of the vehicle (including rental vehicle fees), shipping, damage to the vehicle or components, or other incidental or indirect damage. TBH Performance Co.’s sole liability on any claim of any kind, whether in contract, tort, or otherwise, for any loss or damage arising out of, connected with, or resulting from the manufacture, sale, delivery or use of the products sold hereunder shall in no case exceed the amount actually paid to TBH Performance Co. for the applicable product. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy.
